Propuesta la demanda, se extiende una relación en que conste: 1°. Los nombres y domicilios del demandante y demandado; 2°., lo que se demanda, y 3°. loshechos y razones de derecho en que se funda. En la misma diligencia, que se firma por el Juez, el demandante y el Secretario, se dispone la citación del demandado para que comparezca por sí o por medio de apoderado, a contestar la demanda en la fecha y hora que se señale.

Este señalamiento se hace atendiendo a la distancia a que se halle el demandado, y a la naturaleza y urgencia de la demanda.
