Art. 3.° La expropiacion en tiempo de guerra no podrá declararse ni llevarse á efecto sino cuando al Poder Ejecutivo federal le sea absolutamente imposible procurarse, por operaciones fiscales ó negociaciones ó contratos de otra clase, los objetos, especies ó artículos de que necesite para los gastos de la guerra, y cuando la perturbacion del órden y los progresos de las armas enemigas sean de tal carácter que no haya tiempo que perder por parte de las autoridades legales.
