° Si dentro del terreno que se eligiere para el área de la nueva población, teniendo en cuenta las condiciones de higiene, salubridad, y provision de aguas, etc, se hubieren establecido cultivos se les indemnizará a los respectivos cultivadores, otro lugar haya tomado, y se les entregará en dinero el mayor valor que tengan sus cultivos, previo avaluo en forma legal.
