º . A partir del primero (1º) de enero del año dos mil nueve (2009) regirá como auxilio de transporte a que tienen derecho los servidores públicos y los trabajadores particulares que devenguen hasta dos (2) veces el salario mínimo legal mensual vigente, la suma equivalente al auxilio de transporte establecido por del Decreto 4966 de 2007, incrementado en el índice de Precios al Consumidor calculado entre el 1º de enero y el 31 de diciembre de 2008 y certificado por el Departamento Administrativo Nacional de Estadística - DANE. En caso de que el resultado contenga una fracción en centavos o en pesos, tal monto será aproximado a la centena superior siguiente.
