Art. 703. No probándose el derecho sobre dichos dineros o alhajas, serán considerados o como bienes perdidos, o como tesoro encontrado en suelo ajeno, según los antecedentes i señales.

En este segundo caso, deducidos los costos, se dividirá el tesoro por partes iguales entre el denunciador i el dueño del suelo; pero no podrá este pedir indemnización de perjuicios, a menos de renunciar su porción.
