Art. 51. Corresponde al Gobierno declarar la vacante de los puestos de Magistrados de la Corte Suprema y de los Tribunales, además de los casos determinados en el Art. 7° de la ley 61 de 1886, cuando habiendo transcurrido el termino máximo de la licencia que, según los casos previstos en dicha ley, se les puede conceder, no se presenten a ejercer su destino; salvo el caso de enfermedad o de inconveniente imprevisto que se lo impida a juicio del Gobierno.

En caso de enfermedad de alguno o algunos de los Magistrados de la Corte, podrá prorrogarse la licencia hasta por seis meses.
