Para todos los efectos legales se presume que una persona ejerce el comercio en los siguientes casos:

Cuando se halle inscrita en el registro mercantil;

Cuando tenga establecimiento de comercio abierto, y

Cuando se anuncie al público como comerciante por cualquier medio.
