Si la Corte hallare fundado el recurso enmendará el agravio inferido, dictando el fallo que corresponda como si fuera Tribunal de apelación. Pero en el caso (sic) * se ordenará que el expediente se devuelva para que se profiera el respectivo fallo, si fuere ilegal la abstención de fallar.
