Se castigará con prisión de veinte días a ocho meses al funcionario público que, estando encargado de la custodia de un detenido o preso, le permita, sin estar autorizado legalmente, alejarse por cualquier tiempo del lugar en que debía permanecer detenido o preso; y si por este motivo se realiza la fuga, la pena será de cuatro a treinta y dos meses de prisión.
