Para preservar las normas sobre sigilo y secreto bancario, la Contraloría General de la República cuando considere que debe hacer investigación fiscal en alguna de las entidades de carácter financiero solamente la confiará al personal altamente calificado y los informes estarán sometidos a lo dispuesto en el artículo 40 de la Ley 45 de 1923 . Las sanciones serán impuestas por el Procurador General de la Nación quien podrá elevar a cinco mil ($ 5.000) pesos la pena de multa.
