º. Campo de aplicación . El presente Decreto se aplica a las entidades públicas del orden nacional, incluyendo la Nación, los establecimientos públicos, las empresas industriales y comerciales del estado y las sociedades de economía mixta en las cuales la participación estatal sea igual o superior al 90% y que, por ello, se encuentren sujetas al régimen de aquéllas. Igualmente se aplicará, en lo pertinente, a las transferencias a título gratuito que en desarrollo del artículo 58 de la Ley 911 de 1989, decidan efectuar otras entidades públicas diferentes a las del orden nacional.
