º. Exigencias especiales del contrato irrevocable de fiducia mercantil de garantía. En concordancia con el Título II de la Ley 70 de 1931, los contratos irrevocables de fiducia mercantil de garantía del inmueble financiado que respalden préstamos destinados a la adquisición de vivienda de interés social, otorgados por los establecimientos de crédito que puedan otorgar tales préstamos, deberán contar con el consentimiento expreso del cónyuge o hijos del constituyente según el caso.
