La separación de cuerpos no disuelve el matrimonio, pero suspende la vida en común de los casados. La separación de cuerpos disuelve la sociedad conyugal, salvo que, fundándose en el mutuo consentimiento de los cónyuges y siendo temporal, ellos manifiesten su deseo de mantenerla vigente.
