Art. 41. Cuando practicadas todas las diligencias para el cobro ejecutivo de una multa se declarare insolvente al deudor, la multa se conmutará en arresto á razón de un día de arresto por cada peso en oro de multa. Esta conmutación se hará por el alcalde del respectivo Distrito, para lo cual se le pasará la noticia del caso por el empleado encargado del cobro.
