Salvo las excepciones legales, podrá gravarse con prenda, conservando el deudor la tenencia de la cosa, toda clase de muebles necesarios para una explotación económica y destinados a ello que sean resultado de la misma explotación.

Toda prenda sin tenencia del acreedor se regirá por la ley mercantil.
