Recibida la actuación, el Juez Penal Militar y Policial de Conocimiento o de Conocimiento Especializado señalará fecha y hora para la celebración de la audiencia preliminar al juicio de Corte Marcial, dentro de la cual resolverá las solicitudes de impedimentos, recusaciones, impugnación de competencia, medidas de protección, descubrimiento de los elementos materiales probatorios y evidencia física, su admisibilidad o exclusión y fijará fecha y hora para la audiencia preparatoria. A partir de este momento se entenderá iniciada la etapa de juicio.
