La justicia militar, en su conjunto, tiene por base los mismos principios que la justicia penal de derecho común aunque con todas las modificaciones que la organización especial del Ejército y el interés de la disciplina hacen necesarias. A estos principios ya las disposiciones del derecho común se ocurrirán siempre que sea necesario resolver casos dudosos o no previstos en la legislación militar.
