El testamento cerrado otorgado por una colombiano ó por un extranjero que tenga su domicilio en Colombia, de conformidad con el artículo 1085 del Código Civil, podrá ser abierto por un Ministro Diplomático de Colombia, por un Secretario de Legación encargado de ésta, ó por un Cónsul que tenga patente del Presidente de la República, á petición de la persona en cuyo poder se encuentre el testamento, ó de cualquier colombiano en caso de que el testamento haya quedado en poder del funcionario ante quien se solicita la apertura.
