Son apelables ante el Consejo de Estado las sentencias que dicen los Tribunales Seccionales de lo Contencioso. Administrativo, Administrativo, sobre nulidad de la elección de las ternas para Magistrados de los Tribunales Superiores de Distrito Judicial y para Fiscales de los mismos hechos por las Asambleas Departamentales.

Dicha elección podrán hacerla estas en cualquiera época, sea en sesiones ordinarias o extraordinarias.
