El recurso de casación que establece el artículo anterior se tramitará de acuerdo con lo establecido en el Capítulo I, Título IV, Libro III, del Código de Procedimiento Penal, y habrá lugar a él en los casos de que trata el artículo 567 del mismo Código, y además cuando la sentencia sea violatoria de la ley por haberse dictado sobre un veredicto contrario a la evidencia de los hechos por haber habido error en la apreciación de la prueba del cuerpo del delito.

Establécese expresamente que la Corte tomará en cuenta, en el recurso a que se refiere este artículo, la causal segunda del artículo 567 del Código de Procedimiento Penal.
