Procedencia de la acumulación. Salvo las excepciones legales, una vez contestada la acusación, habrá, lugar a la acumulación en procesos penales comunes, en los siguientes casos:

1. Cuando contra una misma persona se estuvieren siguiendo dos o más procesos aunque en estos figuren otros procesados.

2. Cuando estén cursando dos o más procesos penales y no pueda decidirse sobre uno de ellos; sin que se haya fallado el otro u otros.
