La marca deberá usarse necesariamente en el artículo o producto a que se le destina. Si no se usare dentro de dos años, contados desde la fecha del registro, o si dejare de usarse por un año seguido, caducará el derecho. Pero si la marea fuere extranjera, no es necesaria la importación inmediata del artículo al territorio nacional, y no caducará si fuera de la República se usare dentro del plazo expresado en el artículo o producto a que está destinada.
