La infracción a las prohibiciones de que tratan los dos artículos anteriores acarreará la pérdida del cargo, que será declarada por el Gobierno cuando el infractor sea un miembro de la Junta Directiva, el Presidente o el Liquidador, y por el funcionario competente de acuerdo con los reglamentos internos de la Empresa, cuando se trate de otro funcionario o dependiente de esta. Cuando se trate del Auditor Fiscal o empleados de la Auditoría por quien tenga la función de nombrar a estos empleados.
