Al testigo residente en lugar distinto de donde se sigue el juicio, se le interroga por medio de comisionado, a quien se libra el despacho respectivo, salvo que una de las partes solicite que el examen se haga por el Juez de la causa, caso en el cual este da la orden de comparecencia si el peticionario consigna en el Juzgado la suma que se calcule, a TITULO de indemnización, para gastos de viaje del testigo y de su permanencia en el lugar en donde se presta el testimonio.
