Los superiores con atribuciones disciplinarias deben proceder con estricta imparcialidad y la mayor rectitud. Siempre que la acción punible no conste por la propia observación, por un parte oficial o por manifestación del responsable y, en general, siempre que existan dudas sobre los hechos y el grado de responsabilidad, la falta deberá ser esclarecida por medio de actuaciones verbales o escritas y se dará al acusado la oportunidad para que se justifique.
