Los actos y hechos que realice el Fondo para, el desarrollo de sus actividades comerciales, están sujetos a las reglas del derecho privado y la jurisdicción ordinaria. Los actos producidos en ejercicio de la función administrativa, quedarán sujetos al procedimiento gubernativo establecido en el Decreto 2733 de 1959 y a la jurisdicción de lo contencioso administrativo, con arreglo a las normas sobre la materia.
