El fiscal se posesionará ante el funcionario de instrucción. Este, después de nombrar un secretario, dicta auto cabeza de proceso, en la misma forma como si se tratara de un proceso menor. El auto cabeza de proceso, en casos de deserción, debe contener, además, la orden de captura y detención preventiva del sindicado.
