Art. 418. Se exceptúa de las reglas anteriores el caso de que el delito de que se trata merezca pena capital, porque entonces el sindicado quedará desde el principio en poder de la autoridad civil. Cuando el individuo de tropa fuera aprehendido infraganti delito , y éste no merezca pena capital, el funcionario de instrucción lo pondrá bajo la dependencia del Jefe Militar para los efectos de los artículos anteriores.
