ARTICULO 40. Cuando se presenten oposiciones fundamentadas técnica y jurídicamente, la autoridad competente procederá a evaluar inicialmente los argumentos jurídicos expuestos por el oponente. Si estos prosperan, se negará la solicitud de área de operación, rutas, sistemas o subsistemas de transporte y no se harán efectivas las pólizas de garantía a ninguna de las empresas o sociedades solicitantes. Si la oposición fundamentada jurídicamente no prospera, se seguirá el procedimiento señalado en el artículo anterior en cuanto al aspecto técnico.
