Art. 3.° Para practicar las pruebas requeridas por el artículo que precede, la Corte suprema puede comisionar al Gobernador del respectivo Departamento, ó á cualquiera autoridad del mismo, quienes no pueden declinar la comisión en ninguna otra autoridad ó funcionario sin permiso de la Corte Suprema. En el mismo auto en que se ordene la práctica de las pruebas se designará el funcionario á quien se comisiona, sin perjuicio de designar luégo otro ú otros, y se fijará el término dentro del cual debe cumplirse la comisión.
