Petición del sobreseimiento definitivo o de archivo del sumario. La solicitud fiscal de sobreseimiento definitivo o de archivo del sumario no obliga al juez, quien, si estuviere de acuerdo, dictará la providencia que corresponda. En caso contrario podrá llamara a juicio al sindicado u ordenar al instructor la práctica de las diligencias que considere necesarias para la correcta calificación del sumario, señalándole término no mayor de treinta días, vencido el cual, el proceso pasará de nuevo al fiscal para que formule la petición a que haya lugar.
