º. Adiciónase el artículo 5º del Decreto 1858 de 1995 con el siguiente inciso: Los beneficiarios del régimen subsidiado podrán retractarse de la afiliación efectuada dentro de los cinco (5) días hábiles siguientes a la fecha en la cual se ha manifestado la correspondiente selección, con el fin de garantizar la libertad de afiliación prevista en el artículo 13 de la Ley 100 de 1993.

Parágrafo transitorio

También podrán durante el mes siguiente a la entrada en vigencia de este Decreto, ejercer el derecho de retracto, quienes hubieren sido seleccionados como beneficiarios del subsidio del Fondo de Solidaridad Pensional, entre marzo de 1996 y la fecha de entrada en vigencia de este Decreto.
