ART 149. El funcionario ó empleado público, que estando encargado por razón de su oficio del depósito de planos ó diseños de fortificaciones, puertos ó arsenales, entregare á sabiendas alguno ó algunos á los agentes de alguna potencia extranjera, aunque sea neutral ó aliada, ó les descubriere el secreto de alguna negociación ó expedición de que se hallare instruido oficialmente por su ministerio, será declarado infame y condenado á diez años de presidio.
