Si la empresa o establecimiento tuviere establecida pensión de jubilación, el empleado tendrá derecho a optar entre el auxilio de cesantía, o la pensión de jubilación. Si opta por la pensión, y muriere cuando la suma que se le había cubierto como pensión era de un monto inferior al que hubiere alcanzado el auxilio de cesantía, se cubrirá a los herederos lo que faltare para igualar dicho monto, de modo que, en ningún caso, el valor recibido como pensión pueda ser inferior al que hubiere correspondido al empleado como auxilio de cesantía.
