El fiduciario no tendrá derecho a reclamar cosa alguna en razón de mejoras no necesarias, salvo en cuanto lo haya pactado con el fideicomisario a quien se haga la restitución; pero podrá oponer en compensación el aumento de valor que las mejoras hayan producido en las especies, hasta concurrencia de la indemnización que debiere.
