En los casos en que las obras de utilidad pública sean acometidas por particulares y no se refieran a vías públicas, hay también derecho a la declaratoria de utilidad para los efectos señalados en las leyes, a juicio de las entidades autorizadas para hacer tal declaratoria según el artículo 18 de la Ley 119 de 1890 . Una vez hecha tal declaratoria quedan los representantes de las entidades particulares con personería suficiente para gestionar los juicios de expropiación.
