Art. 1º. Son de competencia de las autoridades militares los delitos comunes cometidos por militares del Ejército Nacional ó de las fuerzas revolucionarias durante la guerra pasada si se hubiere hallado en la fecha de su perpetración en servicio activo ó en comisión militar.
