Art. 17. Los empleados del orden judicial y los ministerios públicos, aun cuando estén en uso de licencia, no podrán ejercer poder en asunto judicial o administrativo, ni abogar un negocio judicial.

Esta prohibición se extienden a menores de 14 años, pues lo mayores de esta edad pueden, con licencia de su curador, intervenir en sus propios negocios también comprende esta prohibición a los que se hallen en interdicción judicial y a los ministro de los cultos.

Los funcionarios del orden judicial no pueden ser mandatarios en negocios de ninguna especie albaceas o ejecutores testamentarios.
