En caso de infracción de los derechos conferidos en virtud de un certificado de obtentor, se aplicarán cuando sean compatibles con el presente Decreto, las normas y procedimientos que establece el Código de Comercio, respecto a las infracciones de los derechos de propiedad industrial, sin perjuicio de las acciones penales a que haya lugar.
