El decomiso será realizado por el funcionario designado al efecto y de la diligencia se levantará acta, por triplicado, que suscribirán el funcionario y las personas que intervengan en la diligencia. Una copia se entregará a la persona a cuyo cuidado se encontró la mercancía.
