Artículo diez y siete. Adscritos al Ministerio de Justicia, créanse los cargos de Auxiliares de Instrucción Criminal que funcionarán en número igual, por lo menos, al de los Juzgados de Instrucción Criminal. Por regla general, cada uno de tales Juzgados tendrá a su servicio un auxiliar de instrucción; pero por disposición del Ministerio de Justicia o del Jefe Seccional de Instrucción, podrán destinarse dos o más de ellos, provisionalmente, al servicio inmediato de la Jefatura o de determinado Juzgado, cuando así lo aconsejen las conveniencias de la justicia investigativa.
