Las penas señaladas en este capítulo podrán reducirse hasta en una tercera parte, con la limitación que se establece en el artículo anterior:

Si el ofensor y el ofendido fueren del mismo grado, pero el último tuviere superioridad en el mando; y

2° Si el ofendido fuere Suboficial o Cabo perteneciente a distinta Unidad o repartición militar que el ofensor.
