Cuando los hechos en que se funde una reclamación aparecieren dudosos, y el reclamante no se conformare con la estimación que de ellos se hiciere, tendrá libre su acción ante el Poder Judicial, para que éste decida en juicio ordinario sobre el interés de la reclamación, á no ser que acepte los términos de arreglo que el Gobierno le ofrezca, previa consulta del asunto con el Consejo de Estado.
