° Obligatoriedad. Toda infracción al Estatuto de Puertos Marítimos origina acción sancionatoria, cuyo ejercicio es obligatorio aunque se haya iniciado acción penal o el infractor se encuentre desvinculado de la actividad portuaria, siempre y cuando la sanción se imponga dentro de los 3 años de producido el acto o hecho que pueda generar sanción.
