Artículo octavo. No podrá prescindirse de las vacaciones mediante pago de sueldos o indemnización, cualquiera que sea su cuantía de ésta. Cuando el trabajador quede definitivamente fuera del servicio, antes de disfrutar de las vacaciones causadas, tiene derecho al pago de la remuneración correspondiente a ellas, pero siempre que presente la prueba sumaria sobre su situación de desempleo. Sin embargo, cuando el trabajador sea despedido sin justa causa, tiene derecho, a las vacaciones causadas y no disfrutadas.
