En la cláusula de caducidad se establecerán los efectos que la misma produce y las prestaciones a que las partes quedan obligadas. En todo caso la resolución que declare la caducidad, en cuanto ordene hacer efectivo el valor de la cláusula penal pecuniaria, prestará mérito ejecutivo contra el contratista y las personas que hayan constituido las respectivas garantías y se hará efectiva por jurisdicción coactiva.
