ARTICULO 143 . Incompatibilidad de la defensa . El defensor no podrá representar a dos o más sindicados cuando entre ellos existieren, o sobrevinieren, intereses contrarios o incompatibles. El funcionario judicial procederá de oficio a declarar la incompatibilidad, mediante auto contra el cual procede recurso de reposición. Dicho auto será notificado personalmente a los sindicados privados de la libertad y se le comunicará al defensor. Si notificados, no se subsanare la irregularidad, el funcionario proveerá para que cada uno de los sindicados tenga su propio defensor. Si los sindicados no designaren defensor, el funcionario lo hará de oficio.
