Art.45. Los autos de sustanciación sólo son apelables en el efecto devolutivo, lo que quiere decir que mientras se decida acerca de la apelación no se suspende la jurisdicción del Juez inferior para seguir conociendo del juicio o diligencias.

Empero, son apelables en el efecto suspensivo los autos siguientes:

1° Los que nieguen pruebas de cualquier naturaleza que sean, y

2° Los que nieguen la apertura del juicio a aprueba ó la prórroga

del término concedido.
