El funcionario que embarace la tramitación de un recurso de Habías Corpus, o no le dé el tramite inmediato, o no actué dentro de los términos fijados en este Decreto, incurrirá, por ese solo hecho, en responsabilidad por detención arbitraria, sin perjuicio de la pena de destitución que le será impuesta por el superior mediante el procedimiento previsto para la imposición de sanciones disciplinarias.
