Si pasado el periodo de observación el médico dictamina que efectivamente, el condenado padece una enfermedad psíquica incompatible con el régimen penitenciario, la Dirección General de Prisiones, previo concepto de los Médicos Legistas, ordenará que sea recluido en un manicomio oficial en que haya una sección con tal fin, donde permanecerá a órdenes de la Dirección General de Prisiones.
